This work shows on which historical misunderstandings and coincidences this circumstance is based and why it hardly meets the standards of legal protection guaranteed by the constitution. Considering the developments of supreme court jurisprudence and previous attempts at legislative reform, it explains why a reform of the legal remedies in criminal proceedings is still necessary.
