'Issues of Fact, Damage and Causality in Post-M&A Disputes': The thesis examines key issues in post-M&A disputes. It focuses on the concept of error in the event of a breach of balance sheet guarantees, the scope of the seller's duty to disclose information when conducting due diligence, the recoverability of damages, and questions of causality. The thesis is supplemented by a study from the 2022 / 2023 winter semester on the establishment of due diligence and its impact on M&A transactions, as well as insights into (arbitration) court practice.
