'The interests of justice - Analysing the concept interests of justice in Article 53 of the Rome Statute of the International Criminal Court': In light of the ICC's controversial Afghanistan-decision in 2019, this thesis examines when prosecution under Art. 53 Rome Statute is not in the 'interests of justice'. The author analyses relevant case law, the Prosecutor's practice, and scholarly approaches. Using classical methods of interpretation, she develops her own definition of the term. Finally, the author deals with the Prosecutor's discretion regarding the interests of justice and the judicial review of such a decision.
